LITIGATION & ARBITRATION

We fight for you! – whether at the negotiating table, in a court of law or before an arbitration panel.

Disputes are as old as mankind. In 21st century business life as well, it is not always possible to avoid litigation and conflicts, since at their heart are the conflicting interests of the parties, on which – apparently – no consensus exists.

At this point, we view our task as primarily to achieve such consensus through negotiation and to develop solution approaches, bringing the seemingly opposing interests into balance. For our clients, we seek discussions with tax and regulatory authorities, with business and contractual partners and, in employment law, above all with the Works Council and the respective party to the employment agreement.

Naturally, we also represent our clients in court and before arbitration panels, since in many cases a dispute cannot be avoided or is precisely the means of choice for achieving the economically optimal objective. We have many years of experience as litigators, not just in the conduct of adversary proceedings but also in the strategic direction of judicial (and arbitral) disputes, as well as in the securing of claims. In addition, our clients may draw on auditors and technical experts insofar as their expertise is necessary for enforcement of a claim. When providing litigation support, we use external service providers to ensure that the best possible public relations work is done.

Insofar as our customers’ issues display a cross-border element or even must be pursued abroad, we call in specialized colleagues from our international network and take on the management of the proceedings. We have acquired particular expertise in disputes relating to corporate law, in employment law and tax law proceedings and – straddling topic areas – in asserting and defending against liability claims of various kinds.
